01These terms and the app license

These Terms of Use govern Cutlify AI’s website and related editing and cloud-processing services. Your agreement is with the operator below ("Cutlify", "we", "us"). Please read these terms before creating an account or using the service. If you do not agree, do not use the service.

For an app obtained from Apple’s App Store, the app license is governed by Apple’s Standard End User License Agreement (EULA), unless a different license is expressly provided with the listing. These terms supplement that license for Cutlify’s services; they do not replace Apple’s terms for the App Store or override mandatory consumer rights.

The Privacy Policy explains our data practices. Acceptance of these terms is not a substitute for separate permission required for third-party AI processing or other consent-dependent uses.

02Eligibility and your account

You must be at least 18 and legally able to enter this agreement. If you use Cutlify for an organization, you must be authorized to bind it and provide content on its behalf.

Use accurate account information, secure your device and sign-in account, and contact us if you suspect unauthorized access. Do not impersonate another person, share access to evade usage limits, or use an account you are not entitled to use. Some features require an account and an internet connection.

03Editing and AI results

Cutlify is a video editor. Its AI features edit a take for you (cuts, framing, camera moves and sounds), write captions, and suggest B-roll, using cloud speech and AI services. Supported languages, durations, formats and limits are the ones shown in the app.

Review every result before using or publishing it. Transcripts and AI edits can be wrong, leave out words, or change what a statement means. Every AI change stays editable, and you decide what to keep. You are responsible for the final video, its captions and claims, and how you share it.

We do not guarantee a particular creative outcome, factual accuracy, uninterrupted service, audience growth, earnings, or results on any social platform.

04Your content and permissions

You retain the rights you have in the recordings and other content you provide. We do not claim ownership of your source footage or edits. Third-party materials remain subject to their owners’ rights, and using Cutlify does not clear music, footage, trademark, publicity, or other rights for publication.

You grant us a limited, non-exclusive permission to receive, host, copy, transmit, analyze, and process your content, and to involve the providers needed to do so, for the purposes of providing the features you request, securing the service, and resolving processing or support issues. This permission lasts for the relevant processing and retention periods described in our Privacy Policy. It does not give us permission to advertise with your recordings or sell them.

AI features use your take’s audio and its transcript only to provide those features, and only after you allow it in the app. Our AI providers do not use them to train their models; see the AI processing section of the Privacy Policy.

You must have the rights and permissions needed to record, upload, process, and share your content, including permission from people where required. Do not upload confidential material or personal information that you are not authorized to disclose to our processing providers. You are responsible for determining whether your use is lawful in the places where you record and publish.

05Acceptable use

Do not use Cutlify to:

• Infringe copyright, privacy, publicity, or other rights; distribute unlawful content; or facilitate fraud, exploitation, threats, or abuse.
• Create or distribute child sexual abuse material or non-consensual intimate content, or unlawfully impersonate or deceive someone.
• Upload malware, interfere with the service, probe other users’ data, bypass security or usage restrictions, or obtain unauthorized access.
• Resell access, misuse automated requests, or reverse engineer restricted components except where applicable law permits that activity.

We may investigate credible reports and restrict abusive activity. Report an alleged rights violation through our contact address, identifying the relevant material, your rights, and a way to reach you. Do not include unnecessary private recordings.

06Purchases, renewals, and cancellations

The manual editor and export are available with an account. AI features (AI edits, captions, B-roll ideas and stock) need a plan or a free trial. The purchase screen in the app states each plan’s price, currency, billing period, included AI edits, and trial conditions; that screen controls. Exports made without a plan carry a small “Made with Cutlify” mark.

AI edits. An AI edit counts when it is applied to your project; a failed or cancelled one does not. Each plan includes a number of AI edits per monthly period. Yearly plans reset their AI edits every month. Unused AI edits do not carry over. A plan described as unlimited is subject to fair use of up to 50 AI edits per day, to protect the service from abuse and automated use.

For App Store purchases, Apple processes payment through your Apple Account. Auto-renewing subscriptions renew for the displayed period unless canceled under Apple’s rules. If an eligible trial is offered, it converts to the displayed paid subscription unless you cancel in time. To avoid an unwanted renewal or trial charge, cancel at least 24 hours before the trial or current period ends.

You can review and cancel an Apple subscription in iPhone Settings → your name → Subscriptions, or follow Apple’s cancellation instructions. Deleting Cutlify or your Cutlify account does not cancel an Apple subscription. Cancellation generally stops the next renewal; Apple’s offer terms determine when access ends, including for trials.

For an Apple-billed refund, use Apple’s refund request process. Eligibility is determined under Apple’s rules and applicable law. Nothing here limits statutory refund, withdrawal, or other consumer rights. Contact us about a missing entitlement or a service problem.

AI edits are service entitlements, not money or transferable property. We will not reduce the AI edits of a period you have already paid for, except where the law permits and with any remedy it requires. Price or plan changes follow the notice and consent rules of Apple and applicable law.

07Third parties and privacy

Cutlify relies on providers for sign-in, hosting, storage, speech recognition, AI, stock media, analytics, and subscriptions. The Privacy Policy lists them and the information involved. Stock videos and photos come from Pexels under the Pexels license.

AI features send your take’s audio outside your device, and the app asks for your permission first. If you do not want this, choose “Not now” and keep editing on your iPhone.

08Availability and your backups

Service interruptions, processing failures, file incompatibilities, or data loss can occur. Maintain independent copies of important files. Cutlify is an editing service; project metadata sync does not provide a complete backup of your original media across devices.

We may maintain or change the service and may discontinue features. Where a change materially affects a paid service, we will provide any notice, continued access, refund, or other remedy required by the purchased offer and applicable law. Urgent security or legal issues may require immediate action.

09Warranties and responsibility

To the extent permitted by law, the service is provided on an “as is” and “as available” basis, without additional warranties of merchantability, fitness for a particular purpose, non-infringement, or error-free operation. This does not exclude any warranty, guarantee, or duty that cannot lawfully be excluded.

To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or lost business opportunities arising from the service. Subject to the exceptions below, our total liability for claims arising out of the service is limited to the greater of US$100 or the amount you paid for Cutlify services in the 12 months before the event giving rise to the claim.

These limits do not apply where prohibited by law. They do not exclude or limit liability for fraud, deliberate misconduct, gross negligence, death or personal injury caused by negligence, or any non-excludable consumer, privacy, or data-protection right. If the law requires a different remedy or a higher level of responsibility, that law applies. The Apple app license may separately govern claims relating to the licensed app.

10Ending use and account deletion

You can stop using Cutlify at any time and delete your account in the app (Settings → Account → Delete account), as explained on the Account & data deletion page. Export anything you want to keep first. Cancelling a subscription is a separate step with Apple.

We may suspend or end access for a material breach, credible security risk, abuse, or a legal requirement. When reasonable and legally permitted, we will explain the reason and give you an opportunity to resolve the issue. You can contact us to challenge a mistake. Termination does not remove any refund or other right required by law.

Retention after account closure is governed by the Privacy Policy and applicable law. Provisions that logically need to continue, including content rights already granted for lawful retained processing, accrued payment obligations, and lawful liability limits, survive only to the extent necessary.

11Disputes, changes, and contact

Contact us first if something goes wrong so we can try to resolve it. You do not waive access to a court, regulator, or other remedy available under applicable law. Mandatory protections and jurisdiction rights in your place of residence continue to apply.

We may update these terms prospectively. We will provide appropriate notice of material changes, and obtain agreement where required. Changes do not retrospectively take away an accrued claim or a non-waivable right. If you do not agree to new terms, you may stop using the affected service, subject to any rights for an existing paid period.

If a provision is unenforceable, the rest applies to the extent lawful. A delay in enforcing a right does not waive it. Apple, Google, and our infrastructure providers do not endorse your content or become parties to these Cutlify service terms simply because we use their services.
